Zoning and Taxing Specifics

Zoning Regulations Per The City of Denton Development Code

Zoning requirements as directed by the City of Denton Municipal Code, Section 35.5.5.2, Regional Mixed Use Centers, specify a RCCD (Regional Center Commercial Downtown) designation. More specifically, under the heading of Residential Use Land Category, Dwellings are permitted above businesses. Permitted uses under this zoning designation area: Attached Single Family Dwelling, Dwelling Above Business, Live/Work Units and Community Homes for the Disabled. For the Multifamily aspect of the project, two limitations apply (Per section 35.5.8):
Limitation one:
L(4) = Multifamily is permitted only:
1. With a Specific Use Permit; or
2. As part of a Mixed-Use Development; or
3. As part of a Master Plan Development, Existing; or
4. If the development received zoning approval allowing multifamily use within one year prior to the effective date of Ordinance No. _2005-224; or
5. If allowed by a City Council approved neighborhood (small area) plan.
Limitation two:
L(6) = Permitted only on 2nd Story and above, when an office, retail, or other permitted uses is on the ground floor along any avenue, collector, or arterial street, otherwise office or retail uses are not required.

Additionally, (Per section 35.5.9) All multifamily proposed as part of a Mixed Use Development in the RCC-D zoning districts shall be subject to a development agreement (the “Development Agreement”) between the property owner and the City which shall be entered into prior to final plat approval for any portion of the development. The Development Agreement shall contain Assurances, other covenants, and a Phasing Plan stipulating that non-residential development will be constructed first and multifamily residential constructed last or only after 50% or more of the non-residential component has been developed.

Setback requirements are designated in section 35.5.3 of the Development Code under the heading of General Regulations. Under the RCC-D zoning designation, no setbacks are required. The Plat for this lot designates a 12.5' Utility Easement on all sides of the subject lot.

The project design designates a first floor "four-square" retail complex, with a second floor "four-square" multifamily complex. Permitting will be allowed for this project design. The Floor Area Ratio (FAR) is calculated as: 38,000 sq. ft. (gross floor area)/63,598 sq. ft. (build able lot size) = 60%. The remainder is parking, landscape and hardscape. A 15' setback on all sides has been designed into the project, although none are required by the Development Code.

The subject project site features the following located utilities: Electricity, Water, Telephone, Cable and Gas/Propane.
